Support Article 97 Process

  ACTION ALERT!

Support proper process and procedure for adhering to Article 97 and the state constitution!

 Call TODAY July 1, 2010!

Ask your State Senato to vote NO on Amendment 31 to S. 2495, An Act to Establish Expanded Gaming in the Commonwealth

While the Massachusetts Land Trust Coalition takes no position on casinos per se, the Coalition concurs with the positions of the Environmental League of Massachusetts, Mass Audubon, the Conservation Law Foundation and The Trustees of Reservations on this amendment.

Amendment 30 gives preference to casino sites on any state owned land greater than 200 acres with direct access to a highway. Most 200 acre plus parcels of state owned lands are conservation lands and are protected by Article 97 of the Massachusetts Constitution. This sets a precedent paving the way for such actions through informal actions by the legislature rather than through proper Article 97 process. This amendment has been set aside.

Amendment 31: In 2002, when a Bioreserve was established in Fall River to protect the region’s water supply and other environmental resources, part of the negotiation included transferring 300 acres of state parkland to the Fall River Redevelopment Authority for a "BioPark." When that transfer occurred, the legislative language explicitly prohibited the use of that land for a casino. This amendment would remove the prohibition.
